Welcome to MountainMitra (MM). By booking any trek, tour, or expedition with us, you acknowledge that you have carefully read, understood, and agreed to the following Terms & Conditions (“T&C”). These T&C apply to all participants (“you”, “client”, “participant”) engaging in services offered by MountainMitra (“MM”, “we”, “our”, “us”).

1. Eligibility

  • Participants must be:

    • 18 years or older; or

    • Accompanied by a legal guardian if under 18.

  • Participants must be mentally and physically fit for trekking.

  • MM reserves the right to refuse participation for safety reasons.

2. Booking & Payment Policy

2.1 Advance Payment

  • A 30% advance payment is required to confirm your booking.

2.2 Confirmation Timeline

  • Confirmation of your booking will be sent within 24 hours (one working day) after we receive the advance payment.

2.3 Balance Payment

  • The remaining 70% balance must be paid on arrival at the pickup location, before the start of the trek.

  • Failure to make the full payment before commencement may lead to denied participation without refund.

Bookings are recommended at least 15 days in advance.

3. Cancellation Policy

3.1 Cancellation by Participant

If you wish to cancel your trek, it is mandatory to notify us in writing.
Cancellation will be effective from the date we receive your request.

Refund Structure:

  • Up to 30 days before trek: 90% refundable

  • 21–30 days before trek: 50% refundable

  • Less than 20 days before trek: No refund

Note:

  • Bank or transaction charges are non-refundable.

  • Refunds are processed within 7–8 business days.

3.2 Cancellation by MountainMitra (MM)

A trek may be cancelled or altered due to:

  • Heavy snowfall or rainfall

  • Natural disasters

  • Landslides

  • Unpredictable weather conditions

  • Government restrictions

  • Any situation beyond our control

In such cases:

  • Refund will not be initiated, but

  • We will arrange another trek of the same cost and similar category, OR

  • Suggest a safe, alternative trek.

If no suitable trek exists in the nearby region, we may recommend cancelling for safety — however, standard refund rules still apply.

 

3.3 If Trek is Interrupted After Starting

If the trek begins but cannot be completed due to:

  • bad weather

  • route closure

  • safety hazards

  • natural issues

No refund will be provided.

MM invests significant resources in logistics, staff, permits, and arrangements that cannot be recovered once a trek has started.

 

3.4 Early Return by Participant

If you voluntarily return early due to:

  • personal reasons

  • fitness issues

  • discomfort

  • emergencies not caused by MM

No refund will be provided.

Example: If you have booked a 6-day trek but complete only 5 days, you cannot claim a 1-day refund.

 

MM invests significant logistical, manpower, and operational expenses in advance, and these conditions are non-negotiable.

4. Participant Responsibilities

Participants must:

  1. Provide correct personal and emergency-contact information.

  2. Follow trek leader and guide instructions at all times.

  3. Carry proper clothing, shoes, and personal essentials.

  4. Respect the environment, wildlife, and local culture.

  5. Report any injury, discomfort, or altitude symptoms immediately.

  6. Avoid intoxication during trekking hours.

5. Health & Medical Conditions

  • Any medical condition (heart issues, asthma, recent surgery, etc.) must be disclosed.

  • MM may require a medical fitness certificate for high-altitude treks.

  • Participation can be denied if your condition poses risk.

  • Trekking involves risks such as AMS, injury, slips, falls, and weather hazards — accepted by the participant.

6. Risk Acknowledgment & Liability Waiver

By joining any MM trek, you acknowledge:

  1. Trekking involves inherent risks (terrain, altitude, weather).

  2. MM reduces risks but cannot eliminate them.

  3. MM is not liable for:

    • Injury, illness, accidents, or death

    • Loss or damage of personal belongings

    • Delays or modifications due to weather, traffic, or natural events

Participation is strictly at your own risk.

7. Travel Insurance

  • Participants are strongly advised to obtain travel, medical, and cancellation insurance.

  • For some treks, insurance may be mandatory.

8. Equipment & Gear

  • Participants must carry required gear as per MM’s checklist.

  • The trek price does NOT include any trekking gear or equipment (e.g., trekking poles, jackets, shoes, backpacks, gaiters, crampons, ponchos, etc.).

  • MountainMitra (MM) can provide trekking gear strictly on a rental basis, only after the customer makes the rental payment in full.

  • Rental equipment will be issued only upon receipt of payment; no gear will be provided without advance rental payment.

  • Participants are responsible for the safe use, care, and timely return of any rented gear.

  • In case of damage, loss, or misuse of rented equipment, the participant must compensate MM as per the applicable repair or replacement charges.

  • Participants are advised to inspect all rented equipment at the time of issue to ensure it is in good working condition.

9. Conduct & Behaviour

  • Respectful behaviour towards other trekkers, staff, and locals is mandatory.

  • Consumption of alcohol, drugs, or intoxicants during the trek is strictly prohibited.

  • Misconduct may result in removal from the trek without refund.

10. Environmental Responsibility

  • MM follows a strict Leave No Trace philosophy.

  • Littering or harming the environment is prohibited.

  • Participants must carry back their waste where required.

11. Itinerary Changes

  • MM reserves the right to modify itineraries due to weather, government guidelines, safety concerns, or unforeseen circumstances.

  • Such changes do not qualify for refunds unless MM cancels the trek entirely.

12. Photography & Media Usage

  • MM may capture photos/videos during treks.

  • By participating, you grant permission for MM to use such media for promotional purposes unless you opt out in writing.

13. Personal Belongings

MM is not responsible for loss, theft, or damage to personal items.

15. Governing Law

These Terms & Conditions are governed by the laws of India.
Any dispute will fall under the jurisdiction of the courts in Uttarakhand.

16. Acceptance

By booking a trek with MountainMitra, you confirm that you have read, understood, and accepted these Terms & Conditions.
